The Tucson Association of Realtors and the Southern Arizona Home Builders Association have established a cooperative arrangement, expressed in writing that welcomes all Realtors to introduce their buyers to the many new home subdivisions now available throughout the Tucson area. Here is what this means to you;
*Buyers enjoy the benefit of having their own Realtor represent them in the preview and purchase of a new home. REMEMBER, NEW HOME SITE AGENTS ARE THERE TO REPRESENT THE BUILDER NOT THE BUYER. This also means that Realtors may negotiate with or on behalf of their buyers and receive compensation from the Home Builder after the close of escrow.
*Home Builders have pledged themselves to a "Single Price Policy", which means that their published prices shall be the same whether sold by the Builder or a cooperating Realtor. You will not pay more when you use your own Realtor to represent you.
*Home Builders require Realtors to accompany their buyers and register them on the FIRST visit to a new home subdivision. This registration will be honored for 30 days by the Home Builder, with an extension of an additional 30 days at the written request of the sales agent. This means that buyers may revisit the site with or without their Realtor, knowing that their relationship with their own agent will be honored and respected. IF YOU GO TO A NEW HOME SUBDIVISION WITHOUT YOUR REALTOR DO NOT SIGN IN AND DISCLOSE TO THE SITE AGENT THAT YOU HAVE REALTOR.
REMEMBER, IT IS TO YOUR ADVANTAGE TO HAVE YOUR OWN REALTOR ACCOMPANY YOU ON THE FIRST VISIT TO ANY NEW HOME SUBDIVISION SITE TO GUARANTEE YOUR REALTOR'S ASSISTANCE IN THE SELECTION, CONSTRUCTION AND CLOSI NG PROCESS OF YOUR NEW HOME!
INVESTORS AND NEW HOME CONSTRUCTION:
The home builder is concerned about declining property values due to the number of investors purchasing homes in new subdivisions. Many home builders are restricting the number of homes sold to investors because of this concern. As long as they do not violate any laws such as fair housing and there currently is no law prohibiting the sale of homes to investors.
HELPFUL TIPS FOR CONSUMERS TO HELP AVOID SOME OF THE PITFALLS OF PURCHASING A NEW HOME.
1. You should read the Arizona Department of Real Estate Public Report. By law, this document must be given to you before you sign the purchase contract. You must sign a receipt for the Report. By signing the receipt, you imply that you have read the report. The Public Report will tell you such things as: flooding and drainage disclosure, description of adjacent land and uses, who provides electricity, telephone, gas, water and sewage disposal, common community and recreation facilties, assurances for completion of improvements, local services and facilities, taxes and assessments, and property owners association details. NOTE: the cover of the Public Report contains a disclaimer by the Department of Real Estate that reads: "Not all of the information in this report has been verified by the Department; certain information has been accepted by the Department as true and accurate based on attestation of the subdivider and/or the subdivider's agents. You should verify all facts before signing any documents."
2. Read the purchase contract. Note that if the builder or developer is not placing your earnest money deposit in escrow, the funds may be placed in the builder's or developer's general funds account, and may be used for any purpose. You could lose the money if the builder or developer declares bankruptcy or otherwise goes out of business. If the funds are not going to be placed in escrow, that fact mustbe stated in a separate paragraph in the purchase contract and you are required to initial that paragraph. Make sure you understand where your earnest money is going to be deposited.
3. Before you sign a purchase contract, drive around the home for at least a mile or more in every direction to see how the surrounding area appears to you and what land use or safety issues exist in the area. Visit the area at different times of the day, on weekends, and in the evening.
4. In areas where there are expanses of vacant land near by, check city or county zoning maps to see if nearby property is zoned for apartments, industrial or commercial use.
5. Read the deed restrictions, also called CC&Rs (Covenants, Conditions, and Restrictions). You may find some of the CC&Rs are very strict, particularly if the subdivision is governed by a homeowner's association.
6. Check out the homebuilder with the Arizona Register of Contractors. You can determine the number of complaints customers have filed against the contractor, whether any are unresolved and whether the builder's license has ever been suspended or revoked.
